Can Homeowners Remove Asbestos in South Carolina?

The honest answer: South Carolina law does allow owner-occupants to handle asbestos in their own single-family residence in some circumstances, but that legal permission is not the same as it being a good idea. Here's the honest breakdown.

What the Rule Actually Says

SCDES's owner-occupant exemption applies to detached, single-family, owner-occupied residences that are not being sold or converted. Rental properties, duplexes, multi-family units, and commercial properties are not covered by the exemption — those require a licensed abatement contractor regardless of who owns them.

What the Rule Doesn't Waive

• Disposal. Asbestos waste, whether generated by a homeowner or a contractor, must go to a permitted asbestos landfill under a proper manifest. You cannot legally put it in your household trash.
• Transport. Sealed, labelled, leak-tight containers only. Personal vehicles are not appropriate for anything beyond very small quantities.
• Fibre release. If your DIY release fibres that cross a property line or contaminate the neighborhood air, that's a violation whether or not the exemption applied to the removal itself.
• Future disclosure. When you sell the property, most disclosure forms ask about known asbestos work. DIY work without documentation creates disclosure headaches.

Why We Don't Recommend DIY on Friable Material

Friable asbestos (popcorn ceilings, pipe lagging, damaged floor tile) releases fibres easily. One wrong move — scraping dry, running a household vacuum, using a standard shop-vac — contaminates the whole house. Contaminated attic insulation, contaminated HVAC ducts, contaminated carpet: the remediation cost after a botched DIY is dramatically higher than the original licensed removal would have been.

When DIY Might Actually Make Sense

• Intact, non-friable exterior transite siding on a small shed, removed whole (not broken), wet-methods, PPE, proper disposal.
• A single vinyl-asbestos floor tile you're leaving in place and covering (encapsulation-by-overlay) rather than removing.
• Sample collection for lab testing — a 1-2 gram sample taken with wet methods and immediately bagged.

Anything beyond that, call a licensed contractor. It's cheaper than the alternative.
